Evaluating advisors
Vetting an advisor for Chevron benefits means confirming three things in writing: which of their services carry a fiduciary duty, what they are paid and by whom across every service line, and whether they can explain the pension payment election, the savings plan brokerage window, restoration plan mechanics, and Net Unrealized Appreciation without reaching for generalities.
A great climb is rarely about raw speed. It is about rhythm: knowing the route, reading the grade, and spending energy where it counts. Choosing who guides that climb deserves the same discipline. This is a due diligence exercise, and it is worth running like one.
A fiduciary duty is a legal obligation to place the client's interest ahead of the adviser's own when giving advice. Under the U.S. Department of Labor's guidance on choosing someone to give retirement investment advice, a person acting in that capacity is expected to exercise the care, skill, and judgment of a knowledgeable and impartial professional, and cannot recommend an investment that serves their own compensation at the client's expense.
The word carries less information on a website than people assume, because it is not an all or nothing label attached to a firm. It attaches to specific relationships and specific services. A firm can act in a fiduciary capacity for advisory accounts while brokerage recommendations elsewhere in the same firm are governed by Regulation Best Interest, and while insurance products are sold through a licensed affiliate under a different framework again.
So the useful question is not whether the word appears. It is which accounts, which recommendations, and which services the standard actually covers, and how the firm is paid in each case. Ask for that in writing. A firm that cannot produce it quickly has told you something.
Our own structure, stated plainly. Investment advisory services at Cadence Capital Investments are offered through Prosperity Financial, a Registered Investment Advisor, which acts in a fiduciary capacity with respect to the advisory services it provides. Securities are offered through Fortune Financial Services, LLC, a Registered Broker/Dealer and member FINRA and SIPC; brokerage recommendations are subject to Regulation Best Interest. Insurance and annuity products are offered through licensed affiliates and agents, which means the firm is fee-based rather than fee-only. That structure is disclosed in full in our Form CRS, linked in the site footer. Ask any firm you interview to describe its own structure in the same terms.
Familiarity with the energy sector is not the same as knowing the plan. A Chevron career produces a qualified pension, a non qualified restoration plan, a savings plan with a self directed brokerage window, appreciated employer stock, long term incentive awards, and a retiree medical arrangement that has to be timed against Medicare. Each carries its own rules, its own tax treatment, and its own deadline.
An advisor who works with these decisions regularly should be able to talk through the following without preamble.
The question is never whether the word fiduciary appears on the website. It is what the word is attached to.
Bring these to a first meeting. What you are listening for is not enthusiasm. It is specificity, and a willingness to put answers in writing.
| Ask this | What a substantive answer looks like |
|---|---|
| Which of your services carry a fiduciary duty, and which do not? | A service by service answer, in writing, naming the registered entity behind each one. Not a single yes. |
| How are you compensated across every service line? | Advisory fees, any commissions, and the underlying costs of recommended investments, itemized. |
| Are you affiliated with, endorsed by, or compensated by my employer? | A direct statement of affiliation status, in writing. |
| How do you model the pension payment election? | A description of the actual inputs and a sample of the written output, with assumptions stated. |
| What is your experience with NUA on employer stock? | The mechanics, the disqualifying steps, and the circumstances where they have advised against it. |
| What conflicts of interest exist in your structure? | Named conflicts and how they are disclosed and managed. Every structure has some. |
| May I have your Form ADV Part 2A and Form CRS? | Both, promptly, without a follow up request. |
| What do the first ninety days look like? | A repeatable process, what you receive in writing, meeting cadence, and who handles the relationship day to day. |
Compensation is where most of the useful signal sits, and where the labels do the least work. Rather than sorting firms into good and bad, it is more productive to understand the structures themselves and what each one asks you to watch.
| Structure | How the advisor is paid | What to examine |
|---|---|---|
| Advisory fee only | Client paid fees alone, with no commissions from product sales anywhere in the firm or its affiliates. | Whether the fee scales with assets, and what implementation support is included once advice is given. |
| Fee-based with an affiliate | Advisory fees, plus commissions earned by an affiliated insurance agency or broker-dealer on certain products. | Which products carry commissions, how those recommendations are disclosed, and which standard governs each service. |
| Commission based | Compensation arises from product sales rather than from an ongoing advisory relationship. | What is being recommended, what it pays, and whether ongoing planning is part of the arrangement at all. |
| Flat or project fee | A stated dollar amount for a defined scope of planning work. | What is inside the scope, what triggers an additional fee, and whether implementation is included. |
| Hourly | Billed against time spent on a defined question. | Good for narrow decisions. Usually thin on ongoing implementation support. |
| Employer provided or plan provided | Guidance offered through the plan itself, sometimes at no direct cost to participants. | The scope of what it covers, and whether it addresses assets and decisions outside the plan. |
No structure is free of conflict. Asset based fees create their own incentives around rollovers and distributions; flat fees can create pressure toward scope limits; commissions create product incentives. What distinguishes a firm is whether it names its conflicts plainly and shows you how they are managed.
Everything above comes from the advisor. These sources do not.
We listen, we map where you stand, and we walk you through the route before you commit to anything. There is no cost and no obligation to begin the conversation.
What does it actually mean when an advisor says they are a fiduciary?
It means that, for the services where the duty applies, they are legally obligated to place your interest ahead of their own. It does not automatically apply to everything a firm does. The same firm may provide advisory services under a fiduciary standard, brokerage recommendations under Regulation Best Interest, and insurance products through a licensed affiliate under a different framework again. Ask which services the duty covers and get the answer in writing rather than accepting the label at face value.
What documents should I ask an advisor for before I engage them?
Form ADV Part 2A, which is the plain language brochure describing services, fees, and conflicts, and Form CRS, the short relationship summary. Ask separately for a complete fee schedule covering advisory fees, any commissions, and the underlying costs of recommended investments. If a professional designation is claimed, ask which body issues it so you can verify it yourself. All of this should arrive without a second request.
Is fee-only always better than fee-based?
Not automatically. Fee-only means client paid fees with no commissions anywhere in the firm or its affiliates, which removes product sale incentives but does not remove every conflict; asset based fees carry their own incentives around rollovers and distributions. Fee-based means an affiliate can earn commissions on certain products, which is a real conflict and has to be disclosed, but it also allows insurance and annuity solutions to be implemented within the same relationship. What matters is whether the structure is disclosed clearly and whether the conflicts are named and managed.
How do I check an advisor's background myself?
Use FINRA BrokerCheck for registration history, employment history, and disclosure events on individuals and firms with a brokerage record, and the SEC Investment Adviser Public Disclosure database for Form ADV filings on registered investment advisers. Verify any professional designation with the organization that issues it. These sources are free, take a few minutes, and are independent of anything the advisor tells you.
What are the signs an advisor does not really know Chevron plans?
Answers that stay general when the question was specific. If you ask how the pension payment election is modeled and hear about the energy sector, or ask about Net Unrealized Appreciation and get a definition rather than the disqualifying steps, the working knowledge is probably not there. Another tell is a description of a plan provision that does not match your summary plan description. Check what you are told against your own documents.
